Law Enforcement Efforts of Theft In Gedong Tataan District Court Based on Pancasila Justice

Abstrak

The crime of theft involves the clandestine taking of another person's property without permission or coercion, resulting in material harm and violating societal values and norms. This study examines the basis for the judge's considerations in the case decided under Decision Number 2/Pid.Sus-Anak/2022/PN.Gdt. The research aims to identify the factors influencing the judge's decision-making process. A normative juridical and empirical juridical approach is utilized, drawing on both primary and secondary data sources. The study's primary data includes insights from judges at the Class II District Court of Gedong Tataan. The findings reveal that, in adjudicating juvenile theft cases, judges consider various legal facts and the results of research conducted by community supervisors (PK). These elements serve as the foundation for the panel's deliberations. However, the Gedong Tataan District Court's facilities and infrastructure still require improvement to fully comply with the standards set forth in the Decree of the Directorate General of the General Justice Agency.
