Progressive Legal Approach to Modern Community Law Enforcement in Indonesia

Abstrak

Law comprises norms and sanctions designed to regulate behavior, maintain order and justice, and prevent disorder. It ensures the existence of legal structures within society. However, legal systems can differ significantly across jurisdictions. For instance, the Indonesian legal system, often referred to as the Pancasila legal system, is distinct from the Anglo-American legal system. It has evolved through processes of discovery, development, adaptation, and compromise. Legal changes typically arise from shifts in societal elements. Despite this, the law is not merely reactive; it actively shapes and is shaped by social changes. Technological advancements, for example, have modernized traditional rural communities, influencing legal enforcement practices. In Indonesia, law enforcement is increasingly analyzed through social and progressive legal frameworks, reflecting a shift towards more dynamic and just legal practices. This research employs library research and data management techniques, focusing on normative legal research through literature, statutes, and other written materials. It adopts a socio-legal perspective, analyzing law as a social phenomenon. The findings underscore the need for social analysis in addressing law enforcement issues, aligning with Satjipto Rahardjo’s progressive law concept, which views law as an integral part of social dynamics.
