PERAN KANTOR PERTANAHAN KOTA JAYAPURA DALAM MENYELESAIKAN SENGKETA TUMPANG TINDIH SERTIFIKAT TANAH
Abstrak
This study analyses the role of the Jayapura City Land Office, particularly its Dispute Control and Handling Section, in resolving overlapping land ownership certificate disputes under Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Regulation Number 21 of 2020. Using an empirical juridical approach that combines structured interviews and observation with a review of primary, secondary, and tertiary legal materials, the study is descriptive-qualitative in nature. The results show that overlapping certificates in Jayapura City are mainly caused by inaccurate manual land measurement, old certificates that have not been digitally mapped, and errors made by landholders in indicating boundaries. Case handling follows a structured administrative sequence consisting of complaint registration, internal case exposure, field verification, summoning of the parties, and mediation, which has resolved twelve cases without recourse to litigation. Obstacles include differing perceptions among disputing parties, the absence of parties who reside far from Jayapura, and limited integration of land data. The Land Office responds through repeated mediation invitations, community outreach, mediator capacity-building, and digital transformation of land records, while upholding the mediation principles of peace, willingness, justice, deliberation, and mutual benefit.
