Reciprocity and Debt in Marriage Traditions in Jambi: An Inheritance Calculation Analysis from The Perspective of Maqāṣid al-Sharī‘ah
Abstrak
In Islamic law, a marriage is happy news that must be spread widely to the public through a wedding reception/walimatul 'ursy without specifying minimum and maximum limits on financing. Of course, as a tradition that has developed in society, the implementation of walimatul 'ursy is in accordance with applicable rules and norms. Some areas of this tradition have different aims and objectives, some give invitation money as a gift and some use it as a loan. This means that this loan must be returned according to the value received. Problems arise when the gift of status by a guest to a shohibul hajah at a reception event is considered a debt and must be repaid when the giver holds a walimah event. In the Jambi Malay community, parents who hold a walimatul 'ursy for their children must have an "inheritance book" which is a guide/record of the value received. This research uses a sociological approach to Islamic law to analyze the tradition of calculating inheritance which is considered a debt. The phenomenon of the tradition of calculating inheritance of debts and receivables in the Jambi Malay community is included in the criteria for tirkah. The positive impact of tradition can ease the burden of financing and strengthen ties of friendship, while the negative impact is calculated as debts that burden the creator and impact the heirs.
