Evaluasi Implementasi Produk Hukum Daerah Kota Balikpapan Tentang Izin Membuka Tanah Negara

Abstrak

The evaluation of the implementation of the municipal of Balikpapan's policies regarding permits to open state land is a part of community service to assist the municipal government in assessing the implementation of Regional Regulation No.1 of 2014 concerning Permits to Open State Land and Mayor Regulation No. 33 of 2017 concerning Implementing Regulation of Regional Regulation No. 1 of 2014 concerning Permits to Open State Land, both in content and in practice. Analysis of the substance of the regulation shows that the provisions in the two regional legal products need to be improved, especially regarding the unclear status of the IMTN, the object of the IMTN, the absence of objection procedures, complaints management, and guidance and supervision. The two regional legal products need to be adjusted to the development of higher laws and regulations. Simultaneously, the implementation side's evaluation shows that there are obstacles in implementing the IMTN, mainly related to coordination with the Land Office, IMTN management procedures, and legality assessment of the land right document.
